Time Clocks Procurement Options
Customers may elect to procure time clock hardware through two options:
- One Time Purchase – Time clock hardware may be purchased through a one-time payment. Purchased time clock hardware will become the property of the customer and may be moved between different hotel locations.
- Monthly Lease Option – Customers that desire to avoid a one-time capital outlay can elect to lease the hardware on a monthly basis. Leased clocks will remain the property of Hotel Effectiveness and no ownership interest will accrue to the Customer. Long-term, customers should expect to spend significantly more money on leasing hardware compared with the one time purchase option. The lease option may be discontinued at any time on 30 days written notice as specified in the Master Service Agreement signed by each Customer or that Customer’s parent organization.
The Limited Lifetime Warranty applies regardless of whether the time clock is purchased or leased.
Option to Purchase of Leased Time Clock During the First Year
During the first 12 months of a time clock lease, the Customer may elect to purchase their leased time clock at the original retail price. Hotel Effectiveness will apply 50% of all lease payments received from the customer by Hotel Effectiveness to the purchase price of the hardware.
(Example using a fingerprint time clock with a purchase price of $995 and a monthly lease cost of $40.00. If a customer decided to purchase this time clock following 6 months of leasing, 6 times $40/month times 50% equals $120 towards the full price of $995 leaving a balance of $875 due).
Servicing Time Clock Hardware
All time clocks are quality controlled and inspected prior to being shipped to a customer. In the event a time clock covered by our Warranty malfunctions, the Customer should contact Hotel Effectiveness through our normal support channels. Hotel Effectiveness will troubleshoot the time clock at no additional charge.
In the event the troubleshooting fails, Hotel Effectiveness will initiate a Return Merchandise Authorization (RMA) process. After 90 days, the customer will be charged a nominal warranty replacement cost (currently $35) and the actual shipping costs. RMA terms and conditions are described below.
Limited Lifetime Replacement Warranty
The limited lifetime warranty applies to all physical merchandise purchased or leased from, and only from, Hotel Effectiveness (excluding Schlage HandPunch Products, swipe cards, proximity cards, and key fobs). The limited warranty is valid for the lifetime of the merchandise while the customer is subscribed to a related Hotel Effectiveness software subscription that includes time & attendance and unless the merchandise is found to have been tampered with or has suffered from damage that is not considered to be from normal and expected use, or has been discontinued from the Hotel Effectiveness line of products. All merchandise will go through the Return Merchandise Authorization (RMA) inspection process to be eligible for the limited warranty. Schlage HandPunch Products have a 1 year warranty.
Time Clock Warranty Details
Hotel Effectiveness Solutions LLC (“Hotel Effectiveness”) warrants to the user ("Customer") that hardware products purchased or leased will be free from defects in workmanship and materials, under normal use and service. Hotel Effectiveness's sole obligation under this limited lifetime warranty shall be, under Hotel Effectiveness's option and expense, to repair the defective product or part, deliver to the Customer an equivalent product or part to replace the defective item, or, if neither of the two foregoing options are reasonably available, Hotel Effectiveness may, in its sole discretion, provide a refund to the Customers actual purchase price paid for the defective product. All products that are replaced will become the property of Hotel Effectiveness. Replacement products may be new or reconditioned. Hotel Effectiveness warrants any replaced or repaired product. The warranty will be effective while the Customer’s Location (i.e. hotel or other worksite location) is actively subscribed to a Hotel Effectiveness time & attendance monthly or annual software service. During the first 90 days following purchase, a time clock will be replaced under the terms of this warranty. After 90 days, a nominal RMA fee (currently $35) plus shipping will be charged under the terms of this warranty.
Unless otherwise agreed to in writing by Hotel Effectiveness, warranties are valid only: (i) at the original location of purchase and within the original country of purchase; or (ii) if the original country of purchase is in the European Union, within the European Union.
No warranty will apply to any Hardware Product or software media that has been (i) modified, altered or adapted without Hotel Effectiveness's written consent; (ii) maltreated or used in a manner other than in accordance with that Hardware Product's or software media's manual; (iii) repaired by any third party in a manner which fails to meet Hotel Effectiveness's quality standards; (iv) improperly installed to the extent that installation causes the unit to malfunction; (v) used with equipment or software not covered by this warranty (such as digital phone lines), to the extent that problems are attributable to such use; (vi) not purchased from Hotel Effectiveness; (vii) used directly or indirectly in supporting activities prohibited by U.S. or other national regulations; (viii) discontinued from the Hotel Effectiveness line of products; (ix)acts of God; (x) unprotected electrical surges; or (xi) used in an environment that would by nature ultimately cause the unit to stop functioning.
Any services provided for Hardware Products or software media which are not covered by warranty will be billed on a time and materials basis.
In the event that the Hotel Effectiveness serial number tag on the Hardware Product has been removed or tampered with, the warranty will be void. Customer may not dismantle or subdivide any Hardware Products sold and warranted as part of a reconfiguration of the tested system. Any attempt to dismantle or subdivide such systems without Hotel Effectiveness involvement constitutes a modification or alteration of the Hardware Product which voids the applicable warranty.
Warranty on Shipping
Upon receipt of the ordered products, carefully inspect the shipping carton for damages. If any damage is detected, make a note on the delivery slip. Either reject the delivery or e-mail us for a "return merchandise authorization" (RMA) tracking number. We will replace the exact product that has been damaged, waiving* shipping charges. (*Note: The product will be shipped at no cost to the user utilizing the same shipping method requested on the original order. Any escalation requested for shipment will be completed at the user's expense.)
Open the delivered package and send back the items that were damaged, including all associated parts. The damaged product will be replaced with a full limited warranty.
In the event that a cross shipment or advance replacement is requested or necessary, Hotel Effectiveness will replace the proposed defective units utilizing regular "Ground" shipping. Any escalation of shipment requested will be completed at the Customer’s expense. (Customer will pay the difference between "Ground" shipment and the upgraded shipment amount.)
Note: If a product is shipped back for warranty redemption and is subsequently found to be functioning properly and in "normal," expected condition, the product will be returned without credit at the purchaser's expense.
Additional Warranty Terms
WARRANTIES EXCLUSIVE: IF A HOTEL EFFECTIVENESS PRODUCT DOES NOT OPERATE AS WARRANTED ABOVE, CUSTOMER'S SOLE REMEDY FOR BREACH OF THAT WARRANTY SHALL BE REPAIR, REPLACEMENT, OR REFUND OF THE PURCHASE PRICE PAID, AT HOTEL EFFECTIVENESS'S OPTION. TO THE FULL EXTENT ALLOWED BY LAW, THE FOREGOING WARRANTIES AND REMEDIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, TERMS OR CONDITIONS, EXPRESS OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES, TERMS OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, CORRESPONDENCE WITH DESCRIPTION, AND NON-INFRINGEMENT, ALL OF WHICH ARE EXPRESSLY DISCLAIMED . HOTEL EFFECTIVENESS NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY OTHER LIABILITY IN CONNECTION WITH THE SALE, INSTALLATION, MAINTENANCE OR USE OF ITS PRODUCTS.
HOTEL EFFECTIVENESS SHALL NOT BE LIABLE UNDER THIS WARRANTY IF ITS TESTING AND EXAMINATION DISCLOSE THAT THE ALLEGED DEFECT OR MALFUNCTION IN THE PRODUCT DOES NOT EXIST OR WAS CAUSED BY CUSTOMER'S OR ANY THIRD PERSON'S MISUSE, NEGLECT, IMPROPER INSTALLATION OR TESTING, UNAUTHORIZED ATTEMPT TO OPEN, REPAIR OR MODIFY THE PRODUCT, OR ANY OTHER CAUSE BEYOND THE RANGE OF THE INTENDED USE, OR BY ACCIDENT, FIRE, LIGHTNING, OTHER HAZARDS OR ACTS OF GOD.
LIMITATION OF LIABILITY: TO THE FULL EXTENT ALLOWED BY LAW, HOTEL EFFECTIVENESS ALSO EXCLUDES FOR ITSELF AND ITS SUPPLIERS ANY LIABILITY, WHETHER BASED IN CONTRACT OR TORT (INCLUDING NEGLIGENCE), FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND, OR FOR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE SALE, INSTALLATION, MAINTENANCE, USE, PERFORMANCE, FAILURE, OR INTERRUPTION OF ITS PRODUCT, EVEN IF HOTEL EFFECTIVENESS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND LIMITS ITS LIABILITY TO REPAIR, REPLACEMENT, OR REFUND OF THE PURCHASE PRICE PAID, AT HOTEL EFFECTIVENESS'S OPTION. THIS DISCLAIMER OF LIABILITY FOR DAMAGES WILL NOT BE AFFECTED IF ANY REMEDY PROVIDED HEREIN SHALL FAIL OF ITS ESSENTIAL PURPOSE.
DISCLAIMER
Some countries, states or provinces do not allow the exclusion or limitation of implied warranties or the limitation of incidental or consequential damages for certain products supplied to consumers or the limitation of liability for personal injury, so the above limitations and exclusions may be limited in their application to you. When the implied warranties are not allowed to be excluded in their entirety, they will be limited to the applicable written warranty. This warranty gives you specific legal rights which may vary depending on local law.
DISPUTE RESOLUTION
The customer may contact the Director of Customer Success in the event the Customer is not satisfied with Hotel Effectiveness's response to the complaint. In the event that the Customer is still not satisfied with the response the Customer is instructed to contact the General Manager and/or President.
GOVERNING LAW
This Limited Warranty shall be governed by the laws of the State of Georgia, U.S.A. excluding its conflicts of laws principles and excluding the United Nations Convention on Contracts for the International Sale of Goods.
